By accessing and using the 3D scanning and fiber analysis services offered by Efsun Butik (efsunbutik.com), you agree to be legally bound by these Terms of Use. If you do not agree with any part of these terms, you must refrain from using our website and services.

These terms constitute a legal agreement between you (the "Client") and Efsun Butik. We reserve the right to modify these terms at any time, notifying changes by posting them on this page.

2. Description of the Service

Efsun Butik provides specialized textile photogrammetry and high-resolution 3D scanning services for the analysis of drape, porosity, and structure of technical textiles. The services include:

• Digitization and creation of point clouds of textile samples.
• Quantitative analysis of parameters such as porosity, fiber density, and virtual mechanical behavior.
• Generation of technical reports and digital mesh renders.
• Advisory on data interpretation for applications in R&D, quality control, and material development.

Results are delivered in the agreed formats (e.g., .ply, .obj files, PDF reports) and are subject to the technical limitations inherent to the scanning process.

3. Rights and Obligations

3.1. Client's Obligations

The Client agrees to:

• Provide textile samples in suitable condition for scanning, informing of any particularities or risks.
• Guarantee that they possess the necessary rights over the samples sent for analysis.
• Use the provided data and reports solely for the declared purposes and in accordance with applicable law.
• Pay the agreed prices for the services within the established deadlines.

3.2. Efsun Butik's Obligations

Efsun Butik agrees to:

• Perform the services with professional diligence and the technical standards of the industry.
• Maintain the confidentiality of the Client's samples and data, except where required by law.
• Deliver results within the communicated estimated timeframes, subject to possible technical unforeseen events.
• Provide a support channel for technical clarifications regarding the delivered reports.

4. Limitation of Liability

The services of Efsun Butik are technical and advisory in nature. The data obtained through photogrammetry is a digital representation and is subject to margins of error inherent to the technique. Therefore:

• Efsun Butik does not guarantee the suitability of the results for a specific purpose not previously communicated in writing.
• We are not responsible for commercial, design, or production decisions made by the Client based on our reports.
• Our maximum liability, in any case, shall be limited to the total amount paid by the Client for the service that gave rise to the claim.
• We are not responsible for damage or loss of samples during transport, unless they are handled by our staff at our facilities and negligence is proven.

5. Intellectual Property and Data

The Client retains all intellectual property rights over the physical samples sent. Efsun Butik retains intellectual property rights over the methodology, software, processes, and report formats used.

Raw scanning data (point clouds, meshes) and derived reports are delivered under a use license for the purposes of the contracted project. Redistribution, resale, or use for training AI models without express written authorization is prohibited.

6. Payment and Cancellation Conditions

Prices are communicated per project or service. A signed agreement or quote is required to start the work. Payment terms are 50% at the start and 50% upon delivery of results, unless otherwise agreed.

The Client may cancel an order before the scanning work begins, and an administrative fee may apply. Once the technical process has started, the initial payment is non-refundable.

7. Termination

Either party may terminate the use of the services if the other party materially breaches these terms and does not remedy such breach within 30 days of notification.

Efsun Butik reserves the right to suspend or terminate access to the website or services, immediately, if it detects fraudulent, abusive use, or use that violates these terms.

These Terms of Use are governed by Spanish law. For any dispute, the parties shall submit to the courts and tribunals of Valencia (Spain), expressly waiving any other jurisdiction that may correspond to them.
